I’ve noticed it’s becoming increasingly common for online retailers to ask buyers to purchase shipping insurance at checkout. Isn’t the seller typically responsible for the goods until they’re delivered? Even if there’s a checkbox requiring the buyer to acknowledge responsibility for loss in transit, that doesn’t seem enforceable under U.S. consumer law. When a buyer files a credit card chargeback for a package lost in transit, the seller would almost always lose, even if the buyer declined shipping insurance.

How many of you actually purchase optional shipping insurance when ordering online?
 
Some places like Buds have a long list of things you agree too and one of those is them not being responsible for lost packages if you don't buy insurance.

Since you click that "Uninsured, Buds is not responsible for last/damaged ect option" you can try a chargeback but they might win since you made that choice.
 
I always opt out of the shipping insurance, because the seller is always responsible for the item until delivery, even if they try to claim they're not.

If you read the Ts&Cs for nearly every shipping insurance you're offered, you'll notice that it's not insuring the package. It's insuring that the seller won't make it as hard as they legally can to process your claim for a lost package.
 
With package theft so common now days I always get the insurance. That way if there's any problem, they just send out another package.

I dunno, companies put all kinds of unenforceable BS in waivers and disclaimers. Many businesses have some kind of indemnity waiver that they make you sign but gross negligence would make them meaningless. TONS of companies say you have to get your product repaired through an authorized dealer or use OEM parts or your warranty is voided, but that goes against the Magnuson-Moss Warranty Act and is not enforceable. I’m not sure if checking a box declining insurance absolves them of liability if a package doesn’t get delivered or is damaged in transit. I really shoulda gone to law school 🤷‍♂️

Maybe I’m mistaken, but even if a seller shifts “risk of loss” to the buyer, it usually doesn’t hold up in credit card disputes. since non-delivery still triggers a refund obligation under the FTC Mail, Internet, or Telephone Order Merchandise Rule.

FTC is very clear on this. 100% of the burden of delivery is on the seller during shipping. They can try and weasel any which way they want with unenforceable checkboxes or agreements but just like the trucks with signs saying “not responsible for broken windshields” it is unenforceable.

Agree, although good luck getting the trucking company’s insurance carrier to pay up unless you have proof. Everyone should have a dash cam!
