Selling some C&R's, just want to make sure I do this right.

Is the following correct as of today's date? Thanks in advance for the input!

The Rifle is a C&R (50+ Years Old) AND the Buyer Has a Valid 03 FFL + CA COE

If the rifle is at least 50 years old (or officially classified as a C&R by the ATF) and both parties are California residents:

  1. Face-to-Face Direct Sale: California law allows a direct, face-to-face transfer for C&R long guns without having to go through a licensed retail dealer (Type 01 FFL).
  2. Verify Credentials:
    • Verify the buyer's valid California Driver’s License / ID.
    • Obtain and inspect a signed copy of their Type 03 FFL.
    • Obtain and inspect a copy of their California Certificate of Eligibility (COE).
  3. Bill of Sale / Proof of Transfer:
    • Write up a signed bill of sale for both of your records listing the date, sale price, rifle make/model/serial number, and both parties' names and addresses.

I've never done a bill of sale. I show the seller my ID to verify who I am. I also show them my 03FFL and COE. I give them a copy of my FFL with my address redacted. All they really need is my name and FFL number.

Also, the seller doesn't have to be a CA resident. Except for one exception, If you have an 03 FFL, you can buy a C&R face-to-face from anyone, anywhere, without going through a dealer. The only exception is if it is a handgun and the transaction is in CA, you have to go through a dealer. But for long guns in CA or for long guns and handguns out of CA, no dealer is needed.

note that for long guns acquired out of state, they need to be reported within (30?) days upon their entrance to the state on CFARS
