3rd Circuit rules NJ AW/LCM bans unconstitutional!!

Good stuff. They seemed to have taken a very clear statistical analysis of "common use" and a narrow view of historic analogs - namely looking at the reasons certain laws burdening 2A were enacted.

"Because magazines are required to operate many firearms, they are “Arms” within the text of the Second Amendment—even when they can hold more than ten roundsof ammunition. Thus, magazines—including those that canhold more than 10 rounds of ammunition—are presumptively entitled to constitutional protection."

"We have observed that “millions of magazines are owned, often come factory standard with semi-automatic weapons, [and] are typically possessed by law-abiding citizens for hunting, pest-control, and occasionally self-defense.”ANJRPC II, 910 F.3d at 116 (citations omitted). Of course, not all magazines satisfy New Jersey’s definition of an LCM. But the 24 million AR-15s and similar sports rifles in circulation—firearms that we have determined are in common use for lawful purposes—typically come standard with twenty- or thirty-round magazines. And there are over 100 million 30-round AR-15 magazines in circulation."

"As with the Assault Firearm Provisions, we need not employ a “nuanced approach” to analogical reasoning about New Jersey’s LCM Provisions. Bans on weapons in common use for lawful purposes are unlawful. See Bruen, 597 U.S. at27; Heller, 554 U.S. at 628–29. So are severe restrictions on weapons in common use for lawful purposes. See Bruen, 597U.S. at 47. However much nuance we might employ, we could not overcome the dearth of relevantly similar Founding-era restrictions."

The dog of wisdom hath spoken

Looking at the list of judges that ruled in favor of 2A, it was 7 Trump nominees along with 1 Bush and 2 Biden.
Dissent was 3 Obama nominees with 1 Bush and 1 Biden.
In yet another sign that the walls are starting to crash down on the Democrats’ unconstitutional gun control platform, it looks like a Biden appointee actually wrote the majority opinion!

We have ACB 💩ting the bed with the birthright citizenship case, gun-grabbing Democrats have Freeman screwing them over on this.

It’s about time that case has been pending since 2018 nice to get some good news for once the ball should start to roll now.

It all comes down to SCOTUS and guessing what SCOTUS will do is a fools errand.
Easy guess

6-3 split with the traditional judges siding with the constitution and the 3 radical liberal judges siding against the constitution with clown world logic

Enough with the birth right citizenship. No one expected limiting that was going to stand through executive order. It’s the same as if Joe Biden had made an executive order claiming you had to be part of a militia to own a gun, and banned guns outright.

This is a great decision, totally reason for celebration!

However, I’m gonna go ahead and buy 10 round mags as needed. Not waiting on the courts to actually follow the constitution in a meaningful way, the ability to buy an un neutered AR/AK, or standard capacity magazines is still likely years away, if ever.

And I really hope I’m wrong.

I buy all of my mags from Country Spirit so that the day the dumb ass law is done away with I can remove the limiters and have normal capacity mags.

It’s shockingly rare a Democrat judge actually follows the constitution these days. Good on her. And this is all thanks to the Supreme Court ruling she cites

Think ca would need a win in Supreme Court. Any district court would go to appeal after appeal. They are good at the court system they control.
we are past that, the supreme court is going to hear our cases

Still don’t have the solid winning cases we need. When I’m not paying an extra 11% tax, when I can buy standard capacity magazines and the ammo to fill them through the mail, when Glocks are free to sell as designed, when I can buy a gun and take it home same day, when ARs don’t need stupid wings attached to the grip, when silencers are cheap and easy to buy.. that’s when we’re winning.

Right now, we are taking fantastic steps away from tyranny, but they’re just a few baby steps.

Well you're in libtard California so it will take some time. By next year we could have legal AW rifles and standard cap mags with the current cases. No idea how long the DOJ roster lawsuit will take. If the next admin flips to Democrat they'll probably drop the suit (obviously they hate us having personal freedom and guns), so we will see how that goes.

Wake up…
Did the roster go away? Did the 10 round mag limit go away? Did the AW "ban" here go away? Can I order barrels and ammo here without paying fees or jumping through hoops?

Can I build a semi auto AR pistol and show it to the cops?

I must have missed this.
