What is the requirement with regards to documentation to purchase/sell antiques from/to a private party in California?

Can you cash and carry without using your C&R and COE + register through CFARS?

If you are defining antique correctly, and you don't have any reason to believe they're a felon, have them hand you cash and hand them the item and go your separate ways.

Have you searched through the ATF's Official published Curio and Relic list? Have you searched the item using any of the AI platforms? Google?

C&R and antique are very different things. C&R list means nothing for an antique.

I was just pointing that out to the OP, seems OP was confused between C&R and Antique and he wanted to double confirm. Without knowing what the actual item is, hard to tell from the original question.

If a rifle was made before 1899 it is an antique. A Finnish Mosin with a 1940's barrel but a pre 1899 receiver (receiver dates are stamped on the underside so many people don't even know they have an antique Mosin) would be antique, as the receiver is the part of the firearm that is the firearm.

Defining antiques in CA law, a) and b) specifically. C) leads to weird stuff like "wallet guns", cane guns", "undetectable firearms" and sbrs etc etc:

I know that guns made before 1899, such as Lowe manufactured Mausers, are considered antiques, meaning you can cash and carry without C&R/COE and not have to register through CFARS.

What about those side by side Belgian coach guns that were popular at some point, yet have no date of manufacture? A gentleman I know has one he got from a reputable company shipped to his door as an antique. How does one go to determine if it's an antique?

If there's really nothing that can verify it was made before 1899 then I would err on the side of caution and treat it as a c&r.

However if a reputable seller sold it as an antique then there's probably something that can identify it as such. Perhaps a serial number, or a proof mark, or knowledge that that model wasn't made past a specific year.
