Law Appeals Court Blocks California’s Background Checks for Ammunition Buyers - (7-24-2025)

I reload most of my ammo, so I inadvertently let my FFL 03 and COE expire. But I just ordered two cases of Federal Syntech Practice Match ammo from Target Sports USA, since it’s supposed to match the velocity, trajectory and point of impact of the HST ammo I carry. I figured I’d take a box along to finish up with every time I shoot one of my carry guns at the range.

I have argued that California's 11% tax (which applies to both guns and ammo) is likely to remain in place; that argument is based on the fact that the federal 11% tax has been in place for nearly a century.

Federal Law and Judicial Rulings mean nothing if counter to the CA 🍌 ideology.
Do you have an example (in gun law) of the state explicitly ignoring a federal court ruling? Or violating federal law and refusing to abide by a judge's order to not do so?
 
The 11% tax on ammunition still may stay in place. It isn’t a done deal unfortunately.

A federal law is a federal law. Does it matter if it is a gun related or not? California has chosen to ignore federal courts in the past. What makes you believe they won’t continue to do so in the future?
 
Due to a recent ruling by the 9th Circuit Court of Appeals, we are no longer required to ship your ammunition purchases to an FFL. You may now order ammunition on our site without selecting an FFL, and have your order shipped directly to your residence.

I wouldn’t get too excited, CA has propensity to do what ever in wants and apply the law as the State see’s fit. Look no further than the CA Sanctuary City Policies. Federal Law and Judicial Rulings mean nothing if counter to the CA 🍌 ideology.

Many were never going to pay the 11% tax on ammunition however. There is no way the state could affectively enforce it. It is not like the state was going to have check points all along the state border searching for ammunition.

36011 Commencing July 1, 2024, an excise tax is hereby imposed upon licensed firearms dealers, firearms manufacturers, and ammunition vendors, at the rate of 11 percent of the gross receipts from the retail sale in this state of any firearm, firearm precursor part, or ammunition.

Retail sale from out of State and bringing into California is currently legal, no 11% excise tax.
Online orders, sale outside of California.

Looks like the buyer is responsible for paying excise tax, ammunition is not on the list.
36011 makes it impossible " imposed upon firearm dealers, firearm manufacturers, and ammunition vendors,"

Since no FFL is needed it remains out of state purchase.
