You can if you have an FFL or if you find a vendor willing to violate currently in effect California law. Odds are the purchaser isn't the one who will be prosecuted if anyone is prosecuted.

Just a nit-noid adjustment: if you are an FFL licensed to conduct business in CA, you are an Ammunition Vendor; if you have an FFL-03, you are not licensed to conduct business, but an FFL-03 with a COE is exempt from the non-importation prohibitions.

I think the big target date is next Friday, the 19th of August, if NOTHING happens - I believe that's the deadline if nothing further occurs. Is this correct?

If you are filing an Amicus brief in support of the petition you have 21 days to submit, if you are filing in opposition of the petition you have 35 days after the petition for an en banc rehearing is requested. The petition was filed on August 7.

Velocity is shipping to California again. People are also once again openly admitting on the Reddit sub they are buying ammo.

As far as I'm aware, nothing has changed and this is still illegal. It still has to go to an FFL if you do not have your FFL03/COE. DO NOT HAVE THE AMMO SHIPPED TO YOUR DOOR.

And if you do, please shut up about it.

I had to have my out of state ammo shipped to an FFL. I was led to believe the FFL would only charge me their handling fee and sales tax. Now they are saying I need to pay the 11% also. Does the 11% really apply to shipped ammo also??

Uh…no. Physically transporting ammo into the state is a citation, but CA PEN 30312(d) makes non-face-to-face (Internet) sales a misdemeanor.

CA PEN 19 says:

…every offense declared to be a misdemeanor is punishable by imprisonment in the county jail not exceeding six months, or by fine not exceeding one thousand dollars ($1,000), or by both.

You can get less, but the offense isn’t a simple citation.

The state and their Amici have filed for en banc review. Plaintiff/Appellees (our side) have until 8/29 to file briefs in opposition to the State’s request for en banc. Then the court decides whether or not to hear the appeal.
