California man arrested and charged for possessing JHPs and standard capacity magazines

If he only had the SBR in his apartment then they're going to consider it "armor piercing handgun ammunition" on the news until it goes to court and that charge disappears under even a modicum of scrutiny. Its a BS charge related to the schrodinger's firearm role SBRs/SBSes play in the state- realistically nobody is going to get charged for owning M855 and an AR pistol unless they're doing something extremely stupid, like casing a location the President is announced to be going to soon while you're already wanted for robbery.

PC 16660 gives us the full definition:
As used in this part, “handgun ammunition designed primarily to penetrate metal or armor” means any ammunition, except a shotgun shell or ammunition primarily designed for use in a rifle, that is designed primarily to penetrate a body vest or body shield, and has either of the following characteristics:



(a) Has projectile or projectile core constructed entirely, excluding the presence of traces of other substances, from one or a combination of tungsten alloys, steel, iron, brass, beryllium copper, or depleted uranium, or any equivalent material of similar density or hardness.



(b) Is primarily manufactured or designed, by virtue of its shape, cross-sectional density, or any coating applied thereto, including, but not limited to, ammunition commonly known as “KTW ammunition,” to breach or penetrate a body vest or body shield when fired from a pistol, revolver, or other firearm capable of being concealed upon the person.

SS109 was designed for 20" AR rifles, so it really doesn't apply. Its just trumped up charges to make it look scarier on the news.
We won't know if the "Armor Piercing Ammo" charge is going to go anywhere until the caliber of the involved ammunition is known.

SS109/M855 ammunition is legal to possess in California because it is a caliber primarily designed for rifles, even if there is some incidental use of the cartridge in handguns.
 
Agree with CadeH and I don’t think anyone caught what he was getting at. The armor piercing ammo charge is dead. CA’s AP law only covers handgun ammo and specifically excludes ammo made for rifles. Green tip was built for AR rifles. Treating the SBR as a handgun doesn’t save it because the ammo still isn’t handgun ammo.

The article says “arrested on suspicion of” AP ammo but the DA didn’t file it so the real charges are robbery, large cap mag (which will be eventually dropped if the mags are not date stamped like Magpul) concealed gun in the car and the SBR charge (he prob made an AR pistol).

So.. if you want to take photos of Trump and scout locations ahead of time go to town. Just don't be a retard rob a bank beforehand and flag yourself as a suspect.
Thats exactly what I was getting at. Its just something to drum up hysteria in the news because an SBR is technically a handgun here, and he had probably M855. He isn't charged for it because it doesn't actually fit the definition of handgun ap ammo here it's just something fluff news bait for the Sheriff
 
Wild but as usual it seems time and time again we see the laws like mag laws or AW config laws seem to only get enforced when you're jammed up on a different criminal issue and they're searching you and throwing the book at you.

Jeanine John Taele, 38, of Downey, who was arrested at Trump National Golf Course Los Angeles in Rancho Palos Verdes, is charged in a federal criminal complaint with possession of an unregistered short-barreled rifle, a felony carrying a mandatory minimum sentence of 10 years in federal prison.
Taele was detained after being seen taking photos and video of security-planning activities ahead of President Trump’s visit to the golf club today.
LASD deputies found ammunition in Taele’s pocket, searched his vehicle, and seized a loaded pistol with a round chambered and a loaded magazine. A search of Taele’s residence seized high-powered firearms, ammunition, body armor, and a notebook.
Taele is also charged in Los Angeles Superior Court with firearms-related crimes and a 2025 robbery. He was granted $250,000 bail in that case.
He is expected to make his initial appearance in the United States District Court in Los Angeles soon after his transfer to federal custody.
Patrick Grandy, FBI Assistant Director in Charge of the FBI’s Los Angeles Field Office, said, “Mr. Taele’s troubling behavior at the President’s public golf course - merely days before the President was expected to arrive - raised serious red flags for law enforcement and led to the discovery of an unregistered firearm, a loaded weapon, as well as additional items of concern. There is no room for error, particularly in light of previous attempts on President Trump’s life, and the FBI’s Joint Terrorism Task Force, working with our partners at the U.S. Secret Service, the ATF, and the Los Angeles County Sheriff’s Department, will investigate this case thoroughly.”

I can't find anything on PACER regarding him so I don't think anything has been filed yet, I was curious to see what the "AP Ammo" they had suspicions about actually was.

I'm pretty sure it was just M855 because he wasnt charged with it, SBRs are handguns in CA so technically he had a steel core ammo for a handgun here. The law requires it to be ammo primarily designed for a pistol rather than a rifle so he won't actually be charged for it.

The PC 32310(a) charge is gonna be really interesting. The (a) subsection covers the importing and manufacturing of a large-capacity magazine. The (b) subsection governs the simple possession of a large-capacity magazine. Enforcement of the (b) subsection has been enjoined by the federal court. Prosecutions are still permitted for the (a) subsection. That suggests that the nice deputies had evidence beyond simple possession.

The PC 211 charge tells me that they linked him to some other crime as well as for the events at the Golf Course.

He had a warrant for a previous burglary

Honestly, I think it's even more nefarious. They made a point to mention hollow-points found when they detained him but didn't mention any M855 during the home search:
  • an illegally modified AR-platform rifle -> possession of an unregistered SBR
  • a .45 pistol,
  • an AR upper,
  • body armor,
  • high-capacity magazines,
  • bulk pistol and rifle ammunition,
  • radios, and
  • “Multiple notebooks containing concerning statements”
In the initial reported charges it was “Possession of armor-piercing or other/dangerous/prohibited ammunition.”, which is not AP specifically.

So they knew they could mention hollow-points and AP ammo to generate hysteria as you said, regardless if that didn't actually stick.

Also, no conspiracy or terroristic threats related charges. ALSO, he was a former Marine deployed to Iraq and Afghanistan but no mention of that in MOST of the "news" reports.

The only things that are definitively illegal:

- possession of an unregistered SBR - did he just not pin the muzzle device?
- loaded concealed handgun (in his vehicle) -> IF he did not have a CCW
 
He was arrested for robbery and got the gun stuff added on… ultimately pretty sus moving around with all that two days before the president gets there

Judging by the picture the FBI posted, the barrel had a length under 16 inches and had a stock.1785962213259.webp
