Could i get away with a 6th PPT sale?

My first 2 years of collecting I went well over. You would think out of all the stupid questions you have to answer during the DROS they would ask if this is less than 6 transfers for the year? I really don't think anyone cares unless you are flipping a bunch for a profit. But buying doesn't seem to be an issue.

Sometimes the transaction will not go through which is hassle for both buyers and sellers if you have to meet up again to do the paperwork over if you’re going to try again.

Also, yes, buying is not an issue/limited beyond 3-in-30 which is removed as a concern at all with the FFL03 + COE exemption.

I think it's currently unclear because I've certainly heard of people being denied for PPTs after 5 in a calendar year. Not sure what triggers it or if there's any rhyme or reason, but it's kind of pain to have to explain to the buyer it might happen and coordinate meeting up again. Especially if one of you is coming from further away. I've had/been the person to drive 4-5 hours round trip to secure a desirable off roster gun or a good deal. Normally as the seller you only have to do that once, for the buyer that potentially means an extra trip as well.

That’s what stopping me from listing 6th firearm for this year. Hate to spoil excitement and waste time for someone

Just keep selling until you get a cease-and-desist warning letter in the mail.

That'll let you know if you made it on a radar.

Keep selling after that C & D letter, then you might be in .

I think they see when acquired and when sold. If quick succession over 5 then you could have some issue

There was a guy in MO i think who the ATF charged with dealing without a license for selling 6 firearms. Think its a case by case thing. In that guys situation I believe each one he flipped within days.

Also not legal advice. These seem consistent with my understanding.

Keep in mind they have records of when each was DROSed. If someone's buying and selling a bunch within 60-90 days, it looks like an unlicensed business, and it's likely to prompt action. On the other hand, if someone transferred 7 or 8 in the same year, but they were acquired over the past 7 or 8 years, I doubt anyone would raise an eyebrow. YMMV.

Only if your prices are consistent/competitive or you have something pretty niche. I sold 5 guns in 1.5 ish months and 3 of them were within 24 hours or less of posting it to the PPT. And most of these were high end guns. Like an average of ~ $7k each across them all.

Also bought one within 12 hours of it going up.

Stuff is always moving if it’s agreeable to both sides. What that number is though and how large a target audience you have is another question.

A lot of sellers are asking wildly above market prices so if you post a reasonable or aggressive sales price it'll go quickly

For me? Yah. For others? Idk, up to them lol. Could be like that lord of war dude with his $2.6k stock g26.3 or the other new dude from today who listed his 19.3 for $2k. Ask them if those ever sell lol.
