DUNCAN V. BONTA GOES TO SCOTUS CONFERENCE - California Large Capacity Magazine Prohibition

It's easier to kill yourself with a gun, that's all. If we didn't have them they would use another method.
That is actually false. Statistically, if using a quick and simple way to commit suicide (such as a gun) is not available, many potentially suicidally people will not kill themselves. Having fewer guns around does significantly reduce the rate of suicides.

We still need to swim about ten miles to shore with this one, so people probably best temper their expectations.
Once again, we're asking via this petition that SCOTUS provide "guidance on which arms the 2A protects", a feat they've failed to accomplish over an honest span of two decades. We can't even get all the lower courts on the same page that magazines are an integral part of firearms which are in "common use", let alone that therefore they're protected under the same umbrella as actual firearms.

With one possible exception, the justices have yet to signal that they care two 💩s about this controversy altogether. They've done a spectacular job ignoring us with the exception of taking on meaningless tangential questions with respect to the 2A once per session.

While I agree they need to be much more specific and spank these lower courts harder the more obvious answer is that these activist attorney generals/state dojs/governors are literally playing games and completely ignoring the the high court. And yes they aren't doing anything about it even if they already gave us a pathway.

💯 💯 💯 💯.

We don't want things to get carried away here. This site for the benefit of Californian's.
That would be nice if it were truly the case, but there are far too many on this site who are in perfect agreement with our overlords in Sacramento. A firearms forum rife with the views of those who voted for Newsom and his ilk is bound to fail. Like oil and water - they are immiscible.

This is so tedious. It’s not enough for people to be enthusiastic about guns, show up to a gun forum and participate. Everyone is ONLY allowed to like guns the way YOU want them to like guns.

Keep wearing your resentment on your sleeve. This moment in American politics is the opportunity of a lifetime for the 2A community. If people could actually see their way to embracing the other end of the political spectrum, 2A could probably dramatically expand the tent. The entire political left feels like this is 1930s Germany with every institution collapsing in around a corrupt wannabe authoritarian dictator. People are terrified, and a little smart messaging could likely convince people on left that they need loosened gun control right now more than the right does. When someone says trump is a 🥔, any remotely savvy person trying to expand gun rights would say “right? Let’s bring back those full capacity magazines and get you a fully functional ergonomic weapon for if / when you have to mount that final stand.” Seems to me, though, that standing on ideology is more important to a lot of people here than actually expanding gun rights.

Gun rights derive from a document that was written by man, is interpreted by man and can be amended by man. Gun rights are political. You want regular capacity mags, NFA items, so on and so forth in California, a state run by democrats? It’s not F-ing rocket science…figure out how to get some democrats onboard. You should count your lucky stars for every left leaning gun owner who is open-minded enough to be on here. They’re already half way on your side. Maybe all the way on your side. But if you don’t know how to talk to people and they leave, that’s on you.

All to say, I see a lot of people patting themselves on the back…recounting how much smarter they are than everyone else… while the actual prize slips further and further out of reach.

You put forth some good points, but the left also has people on it that say "we dont need working class people we will get moderate republicans" a mr senator schumer said this. Also putting Harris up after her job as AG of this fine state of ours when her admin was arguing stuff to the supreme court the same way trumps admin argues stuff but before trump is funny. Maybe before they expand their tent they should see how they engage with the 3rd party people or other voters.

The left is dead. And progressives killed it

Japan has a high rate of suicide but they don't have guns.

There is definitely a disconnect between dems and the working class. It’s bigger than guns so no need to unpack here. But my point is dems need a new national strategy. Gun advocates need a new California strategy. May be time to consider a realignment.

Couldn’t agree more. There needs to a way to reconnect people again

Well when they get their new strategy that isnt "vote blue no matter who" I will consider looking into voting for them, but as you said with SB 50 they will keep their current path in our state, which they also use to lead the national level, so unless they are willing to compromise their position or you and others are willing to vote a 3rd party (gop isnt a choice to me either) then I guess we both have to deal with the way the cookie crumbles. 🤠

That is not at all clear to me. And lacking a court decision that says so, it is also not the reality, at least not yet. Reading the bill of rights, the words "magazine capacity" seem to not be in there. Maybe a copyist error?

I think we need to start thinking through the scenario where the Supreme Court (through action or more likely inaction) says that a magazine capacity limit of 10 rounds is constitutional. Just like the ban on private ownership and use of nuclear weapons (and their components, try buying radioactive materials) is generally seen as constitutional, even though a nuke is an "arm". Some restrictions must exist; deciding where those restrictions are is the job of legislatures and courts.

On the contrary. His unseemly antics are likely to disgust most justices (perhaps excluding Justice Thomas).

With friends like this, who needs enemies? Here, let me do one of those multiple-choice questions that are so popular with standardized tests: Who is a serious enemy of gun rights? A: Judge Benitez. B: The NRA. C: President Reagan. D: All of the above. The correct answer is: D.

Thank you.
i think speaking in terms of restrictions on 10rnd mags and nukes we can look at common practice/common use.

Nukes are not what I would consider “common use”…..a mag that comes from the manufacturer with the firearm is. Seems pretty cut and dry to me.

Who decides what standard capacity is where the current standard capacity for a double stack can be 15-17rnds…???
