Interesting Case Law - Large Capacity Magazines

That's my point. If you actually have to use it for its intended defensive purpose and it gets taken into evidence, it doesn't matter if the cops care. They won't be the ones deciding whether to press charges. You're at the whim of the prosecutor and whatever political message they're trying to send out.
There's a statewide moratorium on prosecution, so no. Not to mention if it was somehow charged - motion to dismiss no evidence

ok boom dismissed

Like what? lmao

Maybe he's saying it might sway the case a certain way if it wasn't a 100% clean shoot in the prosecutors eyes?

To my understanding, the state is not prosecuting mere possession, but continues to prosecute the other aspects ... receiving (e.g. the Newt case), importing (e.g. the Dumbrava case), etc. That's why the type of magazine may impact someone's decision to use it in a defensive situation.

For example, HK's CC9 came out last year. If someone has a +10 mag for the CC9, that fact is all a prosecutor needs to establish that the person received it in 2025 or 2026. I can't see any defense that it was not received or imported in violation of 32310. The prosecutor may turn a blind eye, they may not, but I wouldn't suggest anyone unnecessarily puts their rights in the hands of a prosecutor with a political agenda.

Can't buy that here haha, off roster. Very niche example that doesn't apply. What year was the PDP Compact released? Glad it uses the old PPQ mags I got during freedom week ;) Yeah I agree don't be criminals like those 💩bags and you won't have problems.

"In 2019, Sebastian Dumbrava made threatening social-media comments concerning UC Irvine. Police interviewed him and he was placed on an involuntary psychiatric hold after hospital personnel determined he presented a danger to others. When released two days later, he was given written notice that he was prohibited from possessing firearms and ammunition absent court authorization."

"In People v. Newt, the underlying encounter appears to have been a traffic stop that escalated into a high-speed vehicle pursuit and then a foot flight. When officers recovered the car, an assault rifle with a large-capacity magazine was sitting on the front seat. The published opinion says Newt had committed “numerous crimes” during the incident"

It's not super niche, if we consider the number of popular micros and compacts that came into the market in the past few years with unique mags: Hellcat, Echelon 4.0C, Shield Plus/X, Canik Mete MC9, Ruger Max 9, Taurus GX2, Bodyguard 2.0, VP9A1K (flush), CC9...plus the new factory 15s for the 43x/48. Using a +10 for any of these and having the firearm taken into evidence (even after a defensive encounter deemed a good shoot) can readily result in a charge.

Completely agree ... remember 11th's message and mine specified mags that did not exist before freedom week.
But what if it was a gun released after freedom week and its mags didn't exist before? I think that's where it gets a bit iffy. Not worth the risk IMO.
For mags that existed Pre-Freedom Week, this may be a difficult burden for the state to carry (particularly without transaction records), but for mag designs that came into existence post-2020 (like a PDP Full Size or a Springfield Echelon), it's a relatively simple lift.
[...] but if we're talking about a good defensive use of a concealed Shield X with a 13-round mag, it's going to be taken into evidence and decisions will have to be made.

At the end of the day, everyone has to weigh the level of risk they're comfortable with, but should do so with a clear understanding of what the risk actually is.

A fine mantra indeed ... just need them to get around to creating a version with the paddle release so we grey hairs can use our P99, SW99, and PPQ M1 mags.

How about that P2000 or P2000sk
I like them both so much. Tough decision. I think the PDP being more modern and optic ready and a really good trigger makes it the best overall. But I really like carrying the p2000sk for the form factor
