PPT where the buyer gets denied.

I had a wierd one years ago.
Did a trade plus cash (i gave the cash)
The other party didnt pick up the gun in first 30 days. Ffl told me to try and contact him. I called, text, hit him on discord. No replies.
Another month or 2 went by, still nothing. FFL told me i have 7 days to dros it back to me, or it goes to DOJ to get destroyed.
I went, dros'd it back. Waited the 10 days, picked it up.
It sat in my safe for almost 2 years before I said F- it and sold it. I waited and gave the guy a million and a half chances. I have no clue what ever happened to him.
Should have given him two million chances…cut it short with the half there.

In all seriousness, you waited a good bit before just deciding to sell it. To be frank, we may never know…such as death or unexpected move

I kinda think he wanted the money, and left the country. But i dont know. I got a smokin deal on a rifle though.
 
I live in the north state so a lot of FFLs up here don't care if you exchange cash at the counter. I have been to a couple where they do mind, so if I haven't done business before I ask them: "Do you mind if we exchange money at the counter or do we need to step outside?" If they say step outside they know what's going on and where we went.

I'm not showing anyone a firearm or inspecting someone's firearm in a parking lot. Just asking for trouble imo (getting robbed, a Karen calling 911, don't want to get handed a loaded firearm without a safe direction if seller is careless, etc). FFLs have 4k video/audio of everyone involved at the counter, feels much safer to me. Also the act of checking the firearm into the FFL and stating the intention of the transfer feels like it would offer some legal protection if the seller walked away with the cash before completing it.
I don’t think I’d be super comfortable doing an inspection anywhere other than at the counter and I’d certainly want to inspect before paying. I’ve found that having the money in an envelope and trying to be discrete has yet to offend any FFLs I’ve gone through.

If I was an FFL I would definitely not want weirdos exchanging money in front of the store or in the parking lot of the strip mall. I have no idea if there is a legal reason to not want it in the store so that's a different story

Most stores I've been to basically say they don't want to be aware of it/have it take place out in the open because it might be considered a transaction they'd have to tax or something like that.

Some stores like Aeon Tac or Kovert don't care. Some stores have separate designated areas you can count the money in where maybe the audio/visual surveillance won't pick up, and some require you to step outside.

I've heard that argument about the tax but I feel like that's fudd-lore. But I am fully willing say I don't know either way. I do know that the stores I have done a lot of PPTs at near me don't care, even at turner's I just did it in the store.

It is fudd-lore. Just witnessing the sale doesn’t suddenly make the FFL the retailer.
 
Having done nearly ~30 or so PPTs at probably 10 different gun stores and FFLs I have yet to come across one that said anything about exchanging cash or paying tax when at the counter. I would NEVER exchange cash without inspection and would NEVER inspect outside the store for various reasons. (Karens. Cops, etc)

That aside . . . OP it's your call. You could nothing and keep the money and the FFL will deal with disposing of the gun if DROS fails OR you could earn Karma points and give a refund (less expenses) and list it again. I'm a Karma kind of guy and like to bank those points when possible.

I would just give a refund get the gun back and list it again. Who knows those Karma points might get you a higher price on the resale. Avoid selling to the brother as others have mentioned as you might have to go through it all over again.

I recently sold a firearm to someone and we did a PPT at an agreed upon gun shop. In the course of the transaction I said that the sale was final and there would be no refunds because I intended to spend the money and I did. I just received a message from the buyer stating that their DROS was denied and they would like a refund. I told him to figure it out with the DOJ. He then responded that if it can't be resolved with the DOJ his brother would purchase it. I'm fine with that but it would require me to drive approximately 45min to an hour each way and then spend however long an amount of time in the store. What is the standard etiquette in a situation like this?
That sounds like a straw purchase. I'd go get your gun and sell it to someone who isn't a prohibited person. Not your fault
 
I’ve always wondered about this too. Maybe an FFL can chime in here, but I always thought the background check happened right there and then and the FFL would know if a purchasing party will be able to take possession. That the 10 day waiting period meant, you’ve purchased a firearm, it’s yours, but there’s a wait to take possession “just in case”.

That’s why when I’ve done PPTs, I’ve handed the seller money AFTER we are done in the store. If for some reason I were rejected, the seller would just get gas money but keep the firearm.

EDIT: a quick google search answered my question. The FFL conducts a preliminary check and the DOJ confirms that check within the 10 days OR can delay the release for 30 days, at the end of which the FFL has the discretion to release or not. I guess that means the FFL MIGHT know if you have been flagged as a prohibited person but if you have a common name (John Smith) and there’s 10 “John Smiths” in the area , then the DOJ has up to 30 days to figure out if you are a good John Smith or a bad John Smith.

At any rate, the brother taking over the purchase seems sketch as hell. Very “straw-purchasey” feeling with that one.

Refund minus a 25% restocking fee. He knew he would be denied or should have known, that's on him. I see stores charge 25% pretty often in these situations, that covers your wasted time and travel.

If he's denied again, you have to ask yourself if you want to get dragged into a possible straw man deal with some unknown guy and his brother who can't buy a gun. At that point, you might want to go to the gun store and start a Return to Owner process. You'll have to wait ten days and then go back to the gun store one last time.

The gun shop took possession of the gun they bought. If they can't take possession of it the gun shop will hold on to it for a determined amount of time and then send it off to be destroyed. In this scenario the buyer gets nothing.

I offered to put it on consignment and give him the proceeds. I offered to pick it up and relist it and then after selling venmo the money.Or do nothing and let the store send it to get destroyed. The whole not my circus not my monkey approach. He agreed I will pick it up and let him figure out what happened. It will sit in my safe until he figures it out.

He's not clearing anything up. Either he has a felony, he has an active restraining order or a disqualifying misdemeanor. Right?

Already had a gut feeling and then posted on here and it was confirmed. Told the guy Im willing to try and make him as close to whole as possible any way except transferring it to a friend or brother.

Or he didn't put his SS # on the dros and he has a name of someone who's flagged and just needs to differentiate himself.

I honestly just don’t like this situation you described. Grab your gun. Give him back what you think is fair for your time and gas and move on.
