Open AB-1263 - Online sale ban - I changed the title because it was too clickbaity.

I read in another forum that EGW will no longer ship parts to kommiefor is as of 1-1-26. Too much hassle.
 
So EGW is too lazy to differentiate between a “precursor“ part and some grip screws or a recoil spring? Fck them for being unwilling to do the very minimal work to support 2A in States where they could still legally sell. They are now on my Never Buy From list. Same stupid crap Sam from SG Ammo pulled. Plenty of other vendors out there who support 2A.
 
They need to rethink this policy because they wouldn't even be in compliance with AB1263 by shipping to an FFL. AB1263 doesn't even mention FFLs it only meantions "reasonable controls" meaning taking ID and shipping to the billing address.

I'm kinda waiting until the state promulgates regulations because they should be more specific. There should also be a comment period where we can make public comments and point out if the regs are more broad than the bill text. At some point it will pop up on here: https://oag.ca.gov/firearms/regs
 
I was looking at the 3d printing and manufacturing. because I 3d print. This means that either that its only items and tools that make an firearm an assualt weapon....

OR... Everything that could be used in conjunction with a firearm. I print a handle for a driver bit set or I print out a hammer or an AR vice block... or a grip to make a rifle featureless. or a tpu shoulder pad. Even just owning the printer. This seems wide and overreaching. and super vauge.

Is there any lawsuits challenging this yet? Is the 3d printing or everything ban in effect yet or does that start jan 1st. I am a lil bit overwhelmed from reading it.

Also how does this not violate 1st amendment rights?

If this ever gets overturned it will take years upon years of litigation so buckle in. Maybe a district court judge will strike down the law, but the state will get an almost instant stay on that order. Expect no relief from this law any time soon.

Depends. It is already illegal to print a "firearm" as federally defined - i.e. unserialized lower receivers. Starting Jan 1, you could also be found civilly liable if you use - or help someone else use - a 3D printer or CNC machine (as defined under §3273.50(g)) to print any part used in assembly of an unserialized weapon, including newly defined "firearm accessories". If these parts result in injury or property damage (by you or others), you could be found civilly liable for damages. There's a lot of misconception flying around here... for the time being, I would assume grip modules, magazines, trigger parts, barrels, anything that renders a handgun "unsafe", etc are definitely restricted. Anything that turns your gun into a full auto or replicates it electronically would be a criminal penalty. Vice blocks? Tools? Don't sweat this... and if you want to print an accessory for your own use... honestly I wouldn't sweat that either. Just don't go selling them on eBay from California.

As written, this law does not apply to every single 3D printer - only those which are marketed as or specifically designed for printing firearm parts. Same goes for CNC machines.

Does the restriction on web publishing and dissemination of CAD models, etc violate 1A? Yes.

Didn't think this bill would be this bad when I first heard of it. I am sadly disappointed, as usual. Maybe once this case percolates through the courts our grandchildren will be able to order parts online.
 
AB- 1263 does carve an exemption for FFLs but doesnt list specifcally call out which ones - logic would say its type 1, 06, and 08 but 03 by itself wouldn't without the accompanying COE. From what I can see, everything coming back from vendors is their lawyers interpretations. I got a message from primary arms that said (with the exception of barrels), come January they need a copy of my DL for orders...thats their interpretation!

Interestingly, SB-704 does specially carve C&R FFLs with "proper credentials" (COE) being exempt. Since they are linked, it would be weird to allow 03/credential holders access to barrels but restrict triggers.

Not an attorney - at best an interested keyboard warrior who REALLY likes tinkering with buildouts!

The "reasonable controls", like verifying ID and shipping to billing address, don't need to be done in the case of selling to an FFL or a wholesaler. This is why we are seeing some manufacturers come out and say they won't ship to end users, but they will continue to ship to FFL's and gun stores. Below is the excerpt from AB1263 that applies in this case (with bolded text for emphasis).

3273.51. (e) (4) This subdivision does not apply to the sale or delivery of a firearm barrel, firearm accessory, or firearm manufacturing machine to any of the following:
(A) A federally licensed firearms dealer, manufacturer, or importer.
(B) A licensed ammunition vendor.
(C) A member of the Armed Forces of the United States or the National Guard, while on duty and acting within the scope and course of employment, or any law enforcement agency or law enforcement officer while on duty and acting within the scope and course of employment.
(D) A forensic laboratory.
(E) A wholesaler.
(5) This subdivision does not apply to the delivery of a firearm barrel, firearm accessory, or firearm manufacturing machine to a licensed common carrier or an authorized agent or employee of a licensed common carrier, when acting in the course and scope of duties incident to the delivery of or receipt of these items.
