If you join the GOA you don't need a tax stamp, just buy em regularly now. (At least thats what I believe is happening.)Was just coming back to this thread after the injunction last night to see how it affected AOW's.
Wanting an AOW shotgun and curious how I could achieve this in CA.
Interesting, thank you!If you join the GOA you don't need a tax stamp, just buy em regularly now. (At least thats what I believe is happening.)
If you don't join the GOA, I also have good news for you. As of today, the ATF has begun approving AOW tax stamps for Californians again.
Submitted and approved in less than a week. Meanwhile, I've been waiting over 6 months. If you join the GOA you don't need a tax stamp, just buy em regularly now. (At least thats what I believe is happening.)

I thought we don’t even need a tax stamp anymore? This is confusing lolIf you join the GOA you don't need a tax stamp, just buy em regularly now. (At least thats what I believe is happening.)

I would wait for ATF guidance before you do anything but generally speaking it appears that is a possibility. I URGE everyone to please await ATF instruction. This is 92 years of law that was just declared unconstitutional in one day and thrown out. Let's wait for what they have to say first. To clarify, could I hypothetically join the GOA still today and just throw a fore grip on my SSE AR pistol and get the engraving work done?
Instead of submitting a form 1?
Correct but again I stress waiting for the ATF to say something and also for the other FFLs to say something to. Just wait a bit, we've been waiting a long time, we can wait a little while longer. To clarify, could I hypothetically join the GOA still today and just throw a fore grip on my SSE AR pistol and get the engraving work done?

You are correct in your impression, you MUST be one of the named plaintiffs in the case and the GOA is a membership based organization via $25.00 purchase/donation of a membership and being a member of the GOA entitles you to the permanent injunction federally speaking. However as I've stated previously, I would await ATF guidance and I stress that you DO NOT do anything like put a vertical grip on a pistol or anything like that yet. Do not attempt to buy an AOW and have it transferred to an FFL/SOT unless you plan on applying for an eForm 4 stamp like I did. Once we know more, we can figure out a better plan. But CadeH said it perfectly and this seems to be the case. But don't forget that silencers, SBRs, and SBSs are still illegal here in California and will continue to be and we won't be able to change anything about that for a long time. But when it comes to AOWs, it seems like we may be able to benefit from this injunction.Interesting, thank you!
I was under the imoression the AOW would have to come from one of the named plaintiffs in the case (i.e PSA) to be transferred via 4473 without form 4 AND you would have to be a member of one of the named orgs.
Thoughts?
That was me a year and a half ago with my eForm 4. Once again, congratulations. It feels f*cking amazing, doesn't it?Submitted and approved in less than a week. Meanwhile, I've been waiting over 6 months.
"both current and future" is the wording from the final judgement. If anyone signed up today, would it apply to them or just GOA members pre deadline?

The exact wording from the court decision is as follows:If anyone signed up today, would it apply to them or just GOA members pre deadline?
Bold added as it clarifies your specific question.the Court permanently enjoins the Bureau of Alcohol, Tobacco,Firearms and Explosives, the United States Department of Justice, Todd Blanche in his official capacity, Robert Cekada in his official capacity, their divisions, bureaus, agents, officers, commissioners, employees, and anyone acting in concert or participation with them, including their successors in office, from enforcing the challenged provisions of the National Firearms Act as to untaxed firearms against the plaintiffs and, where applicable, the plaintiffs’ agencies, political subdivisions, members, and customers—both current and future.

The tax stamp is still required in many states and it's on the approved form1 or form4 when you get it back.I thought we don’t even need a tax stamp anymore? This is confusing lol
Here’s where every state stands on suppressor purchases as of today:
- Free States (27) — No NFA process. Alabama, Arizona, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Minnesota, Missouri, Nebraska, New Hampshire, New Mexico, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, West Virginia, and Wyoming. Buy a suppressor like any other firearm — standard background check at your dealer.
- NFA States (15) — The NFA process still applies. Alaska, Colorado, Connecticut, Georgia, Michigan, Mississippi, Montana, Nevada, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, Washington, and Wisconsin. State law still requires the Form 4 process here, and we handle the paperwork end to end — same as always.
- Banned (8 states + D.C.). California, Delaware, Hawaii, Illinois, Massachusetts, New Jersey, New York, and Rhode Island, plus Washington, D.C. Suppressors are not currently legal in these places, and we’re fighting to change that.
You are also a named plaintiff in the case if you are a member of the GOA. There is no requirement to specifically be a customer of silencershop to be a named plaintiff. You are a named plaintiff in the case if you are a customer of silencershop.
"plaintiffs" rather than plaintiff, GOA is one of the plaintiffs. California doesn't require a tax stamp or registration under PC 17710(a) to possess an AOW- the law just requires the AOW to be lawfully possessed under the federal GCA of 1968 to be granted an exemption from state prohibited weapons charges listed under 16590. As a member of the GOA you are lawfully possessing an AOW under the federal GCA without a tax stamp or registration, as there is a permanent injunction against the GCA's registration and taxation and other assorted requirements for AOWs.The tax stamp is still required in many states and it's on the approved form1 or form4 when you get it back.
The tax is $0.

You Could Buy a Suppressor With No NFA Registration | Silencer Shop
A federal court barred the ATF from enforcing NFA registration on Silencer Shop suppressors — no Form 4, no registry, no wait. Here's what it means for you.www.silencershop.com
What if you're like me, someone who actually paid the $5 dollar AOW tax stamp before it became $0, got approved for a red AOW stamp on eForm 4 and is a GOA member? I imagine I am one of maybe a few at most here in California. What happens now?You are also a named plaintiff in the case if you are a member of the GOA.
