Here’s a neutered CA P365 XMacro having its mag disconnect fail.

This is not my gun.

Mine is an off roster XL. I’ve got 6k through it , not the best carry gun, not the worst. I would not carry a gun with a mag disco or LCI. I would be very hesitant to buy anything from Sig except an off roster, older or German P226. Absolutely no CA models.

Don't repair it.

Document everything while it is still in your possession. Video the failure from multiple angles with the serial visible. Photos of the gun and the magwell and the markings. Write down the date you noticed it and every step you took after. Save your report confirmation and any reply you get from Sig in writing. Push all contact to email so there is a record. If they call you follow up with an email summarizing what was said.

Then talk to a litigation attorney before you agree to anything. Go w/ who offers the best terms. Sig will likely offer a repair or a replacement and that offer usually comes with language that ends your claim. Do not sign it. Ask about a preservation letter to Sig so they are on notice not to destroy or alter anything on their end either.

When you do file the main target should be the CA DOJ. Sig can be named but they are not the reason this mechanism is in the gun. The state is. A mandated feature that fails this way is a policy problem and it will not get fixed through a warranty claim.

This is the step towards eliminating the roster.

Store it unloaded and secured somewhere you can show chain of custody. Do not let anyone take it apart.

There's also the middle ground of just taking it out, but the md on a p226 can also fail sig isn't good at designing the compliance parts

That’s posted by Ben Stoeger , a very accomplished , well known shooting champ and instructor during one of his classes. He travels around the country and world teaching. The gun belongs to one of his students.

I don't think OP is saying that the gun in the video is his. Just the fact that it's an inoperable CA compliant one from someone at Ben's class

The md failing isn't a very good facial challenge to the roster regulations because it's likely uncommon and the remedy is just a warranty claim. A better challenge is that the roster caused Glock to make machijegun convertable pistols for an extra 20 years due to the roster meanwhile they took measures on later generations to prevent Glock switches from being installed. The roster actually caused harm on that way.

Thanks @aema15 and @Joker67 fingers crossed Ben didn't push the owner to repair it. Going after Sig is short sighted IMHO go after the CA DOJ. F*ck them.

That’s why I’m okay paying a lil more for off roster handguns
For guns like the P365, that is probably a wise choice. The mag disconnect is an add-on that isn't part of the original design. Hence the failure, although I have seen other videos where the trigger bar return springs fail. Smith & Wesson tend to design their guns with mag disconnects from the start. So they would probably be a better bet in that regard for heavy use.

The issue was determined to be the trigger return spring breaking.. This is a known issue with the p365 whether its off or on roster.
I don't think that it having a mag safety has anything to do with this problem.

Here is Ben talking more about the issue as he saw it

Cagunners and gun owners laugh at me all the time when I tell them I will never get a ca compliant gun with ca required added safeties and LCI's.
I have seen this happen plenty of times people are just ashamed to speak on it cause they thought they were right all along(follow the sheep mentality) until the gun catastrophically fails, but i know what you know and you know what i know and we both know that the rest will find out when its too late.

I laugh at people like you because you can just take the md out and not spend twice as much.

Your laughter is my Laughter....But then you cant put it on.your ccw since it has been modified ,its fine if you want it as a paper weight at home so keep laughing with your paper weight.

Not for a CCW. I don’t know any county that allows that mod. There is no reason to get a P365 series except for CCW. I tried shooting a P365 and an XL in USPSA. It was tremendously difficult for me to do fast follow up shots with accuracy, to do fast reloads , get a good grip as soon as the support hand touches the gun from the draw. I’m not the best shooter , but switching back to a P-01 erased all those problems. A p365 is like a snub nose. It serves a purpose but isn’t very versatile. With the right holster a P-01 or G19 is just as easy to carry and just as easy to conceal.

You can absolutely put it on your ccw with the california 💩 removed. At least in SB county.

I absolutely can put it on my CCW in my county. And the sheriffs that don't allow modifications also don't tend to allow off roster.

Almost every county allows that even los Angeles, there's like one or two counties that don't and they don't allow off roster guns
