Good morning,
Have a friend from out of state and he wants to sell me a springfield echelon but he doesn't want to go through the paperwork here. I want to use it for my ccw training and maybe as a carry. What would I need to do to make it california legal?
My point in all this, as much as it sucks, stay within the law while you’re in this state.
This seems to ignore a whole bunch of procedure.I only really do or have done C&R's, anything one buys at a gun store or Pawn shop you still have a 3 day wait before picking it up as far as long arm's go.
As far as bringing it back to Cali as long as you purchased it legally all you have to do is fill out the state form declaring it which I think costs 20.00 still.
Not sure about anything off roster but CA allows residents to have another state's ID, in Nevada you are only allowed to have a NV ID.
And the Feds still think one must be a resident of a state to buy a gun there, via 18 USC 922 (a)(3 and 5). It is legal Federally to buy a long gun in a different state, but CA's PC 27585 still forces the gun back into a CA FFL.27585.
(a) Commencing January 1, 2015, a resident of this state shall not import into this state, bring into this state, or transport into this state, any firearm that the person purchased or otherwise obtained on or after January 1, 2015, from outside of this state unless the person first has that firearm delivered to a dealer in this state for delivery to that resident pursuant to the procedures set forth in Section 27540 and Article 1 (commencing with Section 26700) and Article 2 (commencing with Section 26800) of Chapter 2.
No one is going to raid this guy because he finds a way to unlawfully register this gun in California.I’ll even add to that. Imagine waking up to a raid that will destroy your entire life for something so minor
You can advise caution or even flat out tell someone it is illegal and don't do it, but do not spread FUD. No one is raiding this guy over one gun. Ever.I think it’s important that on this forum we advise with caution on matters of California gun law
You continue to be wrong. He is a big boy and needs to make his own decisions and be responsible for them. The thing is, no one cares enough to arrest him over a single gun transaction, especially if he does it illegally correctly.…. I assume you’ll represent him in court
Sounds good. So stop spreading FUD then.Do what you want…. Not my problem
I suggest you do the sameSounds good. So stop spreading FUD then.
You may be able to purchase a firearm in another state, while holding a Driver's License from that state, but you can't do so legally.I can go to any gun show, pawn store, gun store and buy a firearm.
I believe I stated no pistols, try again..You may be able to purchase a firearm in another state, while holding a Driver's License from that state, but you can't do so legally.
Please note that the federal definition of "State of Residence" does not depend on whether you hold a Driver's License from that state. Please refer to 27CFR478.11
If you are a California resident (as defined by 27CFR478.11) who holds a Nevada Driver's License and you purchase a handgun in Nevada, you commit a federal felony (refer to 18USC922) at the time of the purchase, and a California state felony when you bring that handgun into California (refer to PC section 27585).
