SSE FIREARMS

I think the argument for point 1 will be that the swapping of parts switched the manner in which the gun operates. You disassembled an SSE and then "manufactured" a semi-auto by swapping parts.

I don't think it's necessarily a good argument, but I think that's the one that would be made.

The counter argument would be if I added spices to made my take out take different did I modify the dish or did I cook the dish?

If I perform a 4WD swap on a truck so its no longer a 2WD vehicle I modified the a core function but I am still not the manufacturer.

I'm with you. I think changing how a product function does not make you a manufacture of the said product. There are also many additional business / legal implication involved if who ever modified the product is considered a manufacturer.

But the manufacturing problem was already addressed by @RickD427

If the courts follow the only definition of manufacturing a firearm under California law in PC 29180(a), fitting together the components of the semi-auto is manufacturing.

I don't think it's right, but I think it's the argument that the DOJ makes, and one that would likely win the day with CA judges.

Reading his response and PC 29180(a) I'm inclined to agree converting a SSE pistol to a semiauto could get you in legal trouble. The prosecution would certainly have a case based on the PC's if they want to pursue it. I'm probably gonna do some more reason on this optic in my spare time. I've been pretty diligent about paying extra money for the off roster stuff to be DROS'ed as a semiauto so I can avoid this issue. Some good discussions here.

I think finding a scenario where this is the sole charge is going to be hard and rare. It would take someone incredibly stupid, such as openly advertising having done this over and over to be charged for it. Otherwise how would any LE even know the status of your firearm?

In jest, since we are in CA, maybe saying my gun identifies as a trans-functional single shot would work?

I think it would have to come straight from the DOJ reviewing DROS records.
 

PEN § 32000​

(a) (1) A person in this state who manufactures or causes to be manufactured, imports into the state for sale, keeps for sale, offers or exposes for sale, gives, or lends an unsafe handgun shall be punished by imprisonment in a county jail not exceeding one year.

(2) The failure to report to the Department of Justice in accordance with the provisions of paragraph (2) of subdivision (e) the sale or transfer of an unsafe handgun obtained pursuant to paragraph (4), (6), or (7) of subdivision (b) may be subject to a civil penalty not to exceed ten thousand dollars ($10,000).

(3) In addition to any criminal penalty provided in paragraph (1), the unlawful sale or transfer of an unsafe handgun obtained pursuant to paragraph (4), (6), or (7) of subdivision (b) may be subject to a civil penalty not to exceed ten thousand dollars ($10,000).

I don't understand why this is so difficult for so many to understand.

A) To the letter of the law, it appears there is nothing specifically prohibiting SSE conversions.

B) Das Gestapo has stated in writing SSE conversions may be illegal and implied threats of prosecution.

C) This is uncharted (un-litigated) territory, caveat emptor.

If that’s the case, why doesn’t a a shop who builds single shots just build it it’s already registered to their store and then they converted before sale to you. That’s because they don’t wanna risk their license.
If you wanna play with your life, trying to argue the meaning of words go ahead it’s your life not mine me personally I don’t have thousands of dollars to fight a court case so each their own I guess
I’ll just keep buying semi auto pistols with no grey area and be at peace knowing my dog nor anyone from my family will be shot in potential raid

You’re right I am paranoid All it takes is for some crazy 🐚. Call the cops and say you have a fully automatic. Then they come to your home to take all your guns to have a separate inspection. Good luck getting them back.

No dummy sse that they made why they don’t sell to you and then on the spot retransfer back to store and back to you. Ask yourself why

That’s why the doj stated the conversion of a sse would be a violation of penal code 32000a via uppers gas block or mag insertions etc. and as for the pawn shop bs I would not rely on them to know gun laws they risk their ffl just to say they haven’t gone after people is a conundrum because they still can they stated and your leaving a paper trail on their “non regristration” paperwork lol they hardly know guns. I’m def not deep pocketed as a fact saving and buying a semi will save me money in the possibility of fighting a court case.

I’d buy a sse only on roster because at least you have the approval to back it up. And juggernaut tactical 9mm pistol is the best option being its runs the way it does just have a mag insert block. Removing that is not manufacturing but changing the way a gun fires is. Just like converting a semi into full auto. Just because some people have them legally doesn’t intend a grey area saying everyone can

Since they couldn’t give me a definitive answer, I was under the impression that they themselves don’t even know the bs they are trying to pass so if so facto 😆 bet NON of you will do this

This means you have created a gun that is not approved on their handgun roster
Also, because they approved their single shot exemption. The only thing you are avoiding is an assault charge. Not the manufacturing charge.
